Action 1: Confirm the Factual Foundation

Before making a determination, verify that the decision is grounded in documented facts — not assumptions, hearsay, or incomplete information.

Why it matters: To ensure the decision stands on evidence, not opinion. Decisions built on weak foundations collapse under scrutiny.

Confirm all relevant facts have been gathered and documented

Verify that witness statements have been collected and are consistent with the evidence

Ensure the timeline of events is complete and supported by records

Check that all relevant policies, regulations, or standards have been identified

Confirm there are no outstanding questions or unresolved gaps in the investigation

Action 2: Structure the Determination

Write the determination using a clear structure that separates what happened, what applies, and what was decided — so anyone reviewing it can follow the logic.

Why it matters: To make the decision transparent and traceable. A well-structured determination is its own best defense.

State the finding of fact: What happened, based on the evidence (facts only, no opinions)

Identify the applicable policy, regulation, or standard that was violated or upheld

Document the options considered (e.g., corrective action, termination, no action, referral)

State the final decision clearly and specifically

Write the rationale: Why this decision was chosen over the alternatives

Ensure the language is neutral, professional, and free of emotional or subjective terms

Action 3: Pressure-Test the Decision

Before finalizing, run the determination through a series of defensibility questions to identify weaknesses an auditor, attorney, or regulator might exploit.

Why it matters: To catch vulnerabilities before they become liabilities. Every decision should be tested before it's final.

Could a reasonable person reach the same conclusion based on the documented evidence?

Is the decision consistent with how similar incidents have been handled in the past?

Does the decision comply with all applicable regulations and organizational policies?

Is the rationale clearly documented and free of assumptions or bias?

Would this decision hold up if reviewed by an auditor, surveyor, or attorney 12 months from now?

Have all affected parties been identified and is the notification plan documented?
